Please read these Terms and Conditions carefully before using RoughCAD software and services provided by Booth Engineering And Design. Your access to and use of RoughCAD is conditioned on your acceptance of and compliance with these Terms.

1. License and Access

Booth Engineering And Design grants you a non-exclusive, non-transferable, limited right to access and use RoughCAD according to the plan, subscription, or service tier purchased.

• RoughCAD Web: Access to the web-based RoughCAD application for the account, seat count, and billing period purchased.
• RoughCAD Desktop: Desktop access may be offered separately when available and may be subject to additional installation, activation, or platform requirements.
• Pro Partner: Custom development, custom asset work, or bespoke services are subject to additional terms described in the applicable partner agreement or statement of work.

2. Accounts and Authorized Use

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to use RoughCAD only for lawful business, concepting, proposal, and layout purposes.

3. Intellectual Property

The software, website, original content, interface, features, branding, and asset systems are and will remain the exclusive property of Booth Engineering And Design, except for materials you upload or provide. You may not reverse-engineer, decompile, or attempt to extract the source code of the software.

4. Use Restrictions

You agree not to:

• Distribute, rent, resell, sublicense, or provide unauthorized third-party access to RoughCAD.
• Remove or alter any trademark, logo, copyright notice, or proprietary notice belonging to Booth Engineering And Design.
• Attempt to bypass billing, access controls, authentication, rate limits, or security features.
• Use the service to upload unlawful, infringing, malicious, or harmful content.

5. No Professional Advice and As-Is Disclaimer

RoughCAD is a concepting and layout tool. It is not a substitute for final engineering calculations, PE stamps, safety certifications, risk assessments, or professional engineering review.

• No warranty: RoughCAD is provided "AS IS" without warranties of any kind.
• Engineering responsibility: The user is solely responsible for verifying the accuracy, safety, and suitability of layouts before physical implementation.
• Site safety: Booth Engineering And Design is not liable for mechanical failures, safety incidents, site accidents, or implementation issues resulting from layouts or concepts created with RoughCAD.

6. Availability and Changes

Booth Engineering And Design may update, modify, suspend, or discontinue features as needed to maintain, improve, or secure RoughCAD. We aim to provide a reliable service but do not guarantee uninterrupted access.

7. Limitation of Liability

In no event shall Booth Engineering And Design be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, business interruption, or loss of business opportunity, arising out of the use or inability to use RoughCAD.
